Passive in the Pluperfect: era stato condannato, era stato assolto
In Italian legal narratives, the passive pluperfect (trapassato passivo) is essential for describing what had happened before another past event.
Forming the trapassato passivo
Imperfect of essere + stato/a + past participle
- era stato condannato (m.) / era stata condannata (f.)
- erano stati condannati (m.pl.) / erano state condannate (f.pl.)
Examples in a legal context
L'imputato era stato condannato in primo grado, ma aveva fatto appello. → The defendant had been convicted in the first instance, but had appealed.
La prova era stata presentata dal pubblico ministero durante il processo. → The evidence had been presented by the prosecutor during the trial.
L'accusato era stato assolto per insufficienza di prove. → The accused had been acquitted due to insufficient evidence.
La sentenza era stata emessa dopo tre anni di processo. → The sentence had been delivered after three years of trial.
Agreement of the past participle
In the passive form, the participle agrees with the subject:
- Il giudice aveva dichiarato... → active
- La sentenza era stata dichiarata... → passive, feminine singular
- I testimoni erano stati ascoltati... → passive, masculine plural
Difference from passato prossimo passivo
- Trapassato passivo: era stato condannato → before another past event
- Passato prossimo passivo: è stato condannato → recent/present result
